1. Introduction

Welcome to Mploy Team. These Terms & Services ("Agreement") govern the relationship between Mploy Team, its clients, employees, and independent contractors. By engaging with our services, you agree to comply with the terms outlined herein.

 

2. Nature of Employment

Mploy Team provides staffing solutions by hiring and outsourcing virtual and on-site employees within the United States, the Caribbean, and South Asia. Employment with Mploy Team does not establish an employer-employee relationship between the employee and the client(s) to whom they are assigned. Employees work on behalf of Mploy Team exclusively.

 

3. Employment Classifications

Mploy Team offers the following employment structures:

- Full-Time Employment: Employees working an average of 40 hours per week.

- Part-Time Employment: Employees working fewer than 40 hours per week.

- Work-for-Hire: Contractors engaged on a project or temporary basis.

 

4. Work Hours & Compensation

- Employees and contractors shall adhere to assigned work schedules as determined by Mploy Team.

- Standard work hours shall not exceed 40 hours per week.

- Mploy Team does not offer overtime compensation.

- Compensation terms shall be determined in the employment agreement and are subject to applicable labor laws.

 

5. Relationship with Clients

- Employees and contractors provided by Mploy Team work on assignments for third-party companies but remain under Mploy Team’s direct supervision and management.

- No employee or contractor shall claim or assume employment with a client company.

- Mploy Team retains all rights to employee and contractor work assignments, including termination and reassignment.

 

6. Confidentiality & Non-Disclosure

Employees and contractors shall maintain strict confidentiality regarding all client information, trade secrets, and proprietary data encountered during assignments. A separate Confidentiality and Non-Disclosure Agreement (NDA) may be required for specific engagements.

 

7. Code of Conduct

All employees and contractors must adhere to professional standards, including but not limited to:

- Compliance with workplace policies.

- Respect for clients, colleagues, and supervisors.

- Prohibition of harassment, discrimination, and misconduct.

- Protection of company and client data.

 

Failure to comply with these standards may result in termination of employment or contract.

 

8. Intellectual Property Rights

Any work product created by employees or contractors during the course of their assignments shall remain the property of Mploy Team or its clients as specified in contractual agreements.

 

9. Termination & Resignation

- Mploy Team reserves the right to terminate employment or contractual agreements at its discretion, in accordance with applicable laws.

- Employees and contractors must provide a minimum notice period as outlined in their individual agreements.

 

10. Legal Compliance

Mploy Team operates in compliance with applicable employment laws within the United States, the Caribbean, and South Asia. Any disputes arising from employment or contractual relationships shall be resolved in accordance with governing jurisdictional laws.

 

11. Limitation of Liability

Mploy Team shall not be liable for any indirect, incidental, or consequential damages arising from employment or contractual relationships. Employees and contractors agree to indemnify Mploy Team against claims related to their work performance.

 

12. Amendments & Modifications

Mploy Team reserves the right to amend these Terms & Services at any time. Continued engagement with Mploy Team constitutes acceptance of any revised terms.

 

13. Governing Law

These Terms & Services shall be governed by and interpreted in accordance with the laws of the jurisdiction in which Mploy Team operates.
